Quotes and Project Approval
A website inquiry does not create a contract or reserve a place in the build schedule. A project becomes confirmed only after the scope, price, payment schedule, and other required details are approved in writing and the required deposit is received.
Pricing and Changes
Quotes are valid for the period stated on the quote. Material costs and availability may change. Customer-requested changes after approval may result in additional charges and a revised completion date. Any added charges will be communicated before the added work is performed.
Deposits and Payments
Custom-project deposits are non-refundable because they reserve build time and may be used to purchase project-specific materials. Remaining balances and any progress payments are due according to the approved quote or invoice.
Cancellations
If a customer cancels after approval, the deposit remains non-refundable. The customer may also be responsible for completed labor, special-order materials, non-returnable supplies, storage, or other costs incurred beyond the deposit, to the extent stated in the project agreement and allowed by law.
Completion Dates
Completion dates are good-faith estimates, not guarantees, unless expressly stated otherwise in writing. Delays may occur because of material availability, supplier delays, weather, illness, equipment issues, customer changes, finish cure times, delivery conditions, or other circumstances outside my reasonable control.
Delivery, Pickup, and Inspection
Customers are responsible for providing accurate access information, including stairs, doorways, parking restrictions, and other delivery conditions. The customer should inspect the piece at delivery or pickup and promptly report any visible concern. Additional delivery attempts, unusual access, or storage may result in added charges when disclosed in advance.
Wood Characteristics
Wood is a natural material. Variations in grain, knots, color, texture, mineral streaks, checking, and seasonal movement may occur and are not automatically defects. Indoor humidity, sunlight, heat, moisture, and care practices can affect a wood product over time.
Intellectual Property
Website text, branding, logos, original photographs, and original designs belong to Benner Built or their respective owners and may not be copied or used without permission.
Limitation of Liability
To the fullest extent allowed by law, Benner Built is not responsible for indirect, incidental, or consequential damages arising from use of the website or a product. Nothing in these terms limits rights that cannot legally be limited.
Governing Law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
